David Martin obtains reversal in Fradulent Transfer Case
The Alabama Court of Civil Appeals recently clarified the law in Alabma on whether a judgment creditor may challenge a property settlement in a divorce as a fraudulent transfer. RES-GA Lake Shadow, LLC v. Kennedy, 2017 WL 65338 (Ala.Civ.App. Jan. 6, 2017). On appeal from dismissal of the claim, the Court of Civil Appeals agreed with David's client that a property settlement agreement can be attached as a fraudulent transfer under Alabama's version of the Uniform Fraudulent Transfer Act.
