Nelson Gill obtains reversal from Eleventh Circuit in insurance coverage case
Nelson Gill recently received a favorable ruling from the Eleventh Circuit Court of Appeals in regard to an insurance coverage issue. Mr. Gill represents plaintiffs who received an arbitration award for damages against a general contractor. In a declaratory action, the contractor’s insurer asserted that the damage award was not covered by, or was excluded by, the contractor’s commercial general liability policy. The District Court had ruled in favor of the insurer, finding that the damage award was excluded by the “your work” policy exclusion. However, on appeal, the Eleventh Circuit reversed the District Court, and held that the District Court’s ruling in favor of the insurer was in error. Auto Owners Insurance Company v. L.
